ScalifySWAS is operated by Simple Scalable Solutions Co., Ltd.
These Terms of Use apply to the ScalifySWAS website (scalifyswas.com, the “Site”), the ScalifySWAS client portal and platform, and associated services (together, the “Services”). By accessing or using the Services, you agree to these Terms, our Privacy Policy and any additional terms that govern specific services, such as your plan agreement.
1. Who we are
ScalifySWAS is operated by Simple Scalable Solutions Co., Ltd. (“COMPANY”, “we”, “our” or “us”), a company registered in Thailand (Tax ID 0105567138759), at T-One Building Thonglor, 20th Floor, 8 Soi Sukhumvit 40, Bangkok 10110, Thailand. References to ScalifySWAS in these Terms mean the Services provided by Simple Scalable Solutions Co., Ltd.
2. Intellectual property rights
All content, functionality and intellectual property on the Site and in the Services, including the ScalifySWAS name and logo, are the exclusive property of COMPANY or our licensors. You may not modify, distribute, reproduce or create derivative works without our express written consent. Work we create for you under a paid plan is covered by your plan agreement.
3. Limited licence to users
We grant you a non-exclusive, non-transferable licence to access and use the Site and Services for your internal business use, subject to these Terms.
4. Your content
Content you submit to us, including through forms, requests, feedback or support channels, grants COMPANY a royalty-free licence to use, modify and display it as needed to deliver the Services. You keep ownership of your content, your customer data and your business data.
5. Access and registration
To access certain features, such as the client portal, you may need to register and provide accurate information. You are responsible for keeping your login credentials confidential and for all activity under your account.
6. Restrictions
You agree not to:
- Violate laws or third-party rights
- Reverse-engineer or hack the platform
- Upload harmful or malicious content
- Use the Services to distribute spam or unsolicited communications
7. Paid services
ScalifySWAS plans, setup fees and add-ons are set out in your plan agreement. Prices on the Site are in Thai baht and exclude VAT. Third-party costs, such as advertising spend, are paid by you. By using paid services, you agree to be financially responsible for your transactions.
8. Connected services
You can connect third-party services to ScalifySWAS, such as Google Analytics, Google Search Console, Meta, LINE and payment providers. Each connection is subject to that provider's own terms. We only use the access you grant to provide the Services, and you can disconnect at any time. How we handle data from these services, including our commitments for Google user data, is set out in our Privacy Policy.
9. Disclaimers
The Site and Services are provided “as is” without warranties. We make no guarantees regarding uptime, accuracy or outcomes. We are not liable for any damages arising from your use of the Services, except where the law does not allow this to be excluded.
10. HIPAA and data protection
Where applicable, COMPANY complies with HIPAA and acts as a Business Associate. We are also committed to Thailand's PDPA, the GDPR and other data protection regulations. See our Privacy Policy.
11. Termination
We may terminate or suspend access without notice if you breach these Terms. On termination, all licences granted to you end. Termination of a paid plan is governed by your plan agreement.
12. Governing law
These Terms are governed by the laws of Thailand. Disputes shall be subject to binding arbitration in Bangkok, Thailand.
13. Changes
